These Terms and Conditions become effective on 25 May 2018

  1. Basic Information and Reservation Conditions
    1. The Operator of PARKIA and the manager of the car park is the travel agency Invia.cz, a.s., Na Hřebenech II 1718/8, 140 00 Prague 4-Nusle, IN: 26702924, VATIN: CZ26702924 (hereinafter referred to as the ‘Operator’).
    2. The PARKIA service offers renting of a parking area by renting individual parking spaces on this area, which is located on the edge of Prague 6 - Ruzyně in the WESTPOINT DISTRIBUTION PARK, about 7 km from Václav Havel Airport Prague (hereinafter referred to as the ‘Car Park’). The service includes the transport of Customers and their luggage from the Car Park to the departure hall of the Václav Havel Airport Prague and back (hereinafter referred to as the ‘Transport’). The Transport is provided by the Operator’s minibuses (hereinafter referred to as the ‘Minibus’).
    3. The Car Park provides 24/7 service.
    4. The Car Park is paid and guarded by an automatic camera and security system.
    5. A car park attendant is always available at the time of arrival and departure. If the Minibus is not waiting for arrival, it should be ordered at the phone number +420 774 095 820; and at +420 226 000 201 in case of any problem.
    6. Parking fee prices are listed in the appendix to these Terms and Conditions. Valid prices can also be found in the office in the Car Park or at www.parkia.cz. The price for airport transfers is included in the parking fee. Each commenced day is included in the price.
    7. Parking can be reserved up to 1 (one) year in advance. The maximum length of parking is 1 month, unless expressly agreed with the Operator on the basis of an individual written agreement or agreement for a longer period. The Operator of the Car Park is in no way responsible for damage to the parked vehicle after this time.
    8. Parking spaces are reserved by calling 226 000 201, by email to: parkoviste@parkia.cz, or via the form on www.parkia.cz.
    9. More than 5 reservations cannot be made on one name, email contact or phone number within a period of one year. The Operator has the right to check Customer’s identity upon arriving in the Car Park. A higher number of reservations are possible based on an individual written agreement with the Operator. The reservation is non-transferable to another person without the consent of the Operator, otherwise it will no longer be valid and parking will not be possible.
    10. The Operator is entitled to cancel the reservation without giving reasons, unless the person making the reservation provides their full contact details required by the reservation system, i.e. the time of arrival in the Car Park, car registration number, email contact or telephone number.
    11. Parking reservation is always only for one specific date, and individual or consecutive reservations cannot be combined (e.g. 14-day parking is not possible using two consecutive reservations, each for one week; one reservation is required for the entire period during which the Customer is interested in parking). If the Customer does not arrive on the day of parking reservation, the reservation will be deemed cancelled without the right to return the paid parking space. Conversely, if the Customer does not leave the parking space on the day of the reservation validity end, the Operator may charge a contractual penalty of up to CZK 500 per day.
    12. The operation of the Car Park is managed by the car park attendant and the people parking there are obliged to follow their instructions.
    13. Customers are understood to be drivers of motor vehicles moving in the Car Park area and also, inherently, the fellow-passengers.
    14. The provisions of Act No 361/2000 Coll., On Road Traffic and on Changing Certain Acts, as amended (the Road Traffic Act) is applicable throughout the Car Park area.
  2. Rules for Using the Car Park
    1. Customers are required to comply with these Terms and Conditions, to observe parking signs, car park attendants, minibus drivers and other persons authorized by the Operator when entering the Car Park, driving and parking the vehicle and leaving.
    2. By entering the Car Park, the customers agree to the provisions of these Terms and Conditions, and they make an agreement with the Operator at this point, which includes the provision of a parking space for the motor vehicle driver and their fellow-passengers, and the driver’s obligation to pay parking fee and comply with these Terms and Conditions. Drivers of motor vehicles moving on the Car Park premises declare that they are the operators or authorized holders of these motor vehicles.
    3. Only motor vehicles with a valid registration number which are in good technical condition and the maximum permissible weight of which does not exceed 3500 kg may enter the Car Park.
    4. Parking spaces are clearly marked with numbered boxes (‘parking spaces’) in the Car Park area. Customers are authorized to park motor vehicles exclusively in these parking spaces. If a Customer parks a motor vehicle in such a way that it interferes with other parking spaces or outside the parking space, he or she is obliged to pay a fee for other parking spaces.
    5. Motor vehicles excluded from the motor vehicle registry, vehicles permanently technically ineligible for operation, and motor vehicles parked for more than 3 months in the Car Park shall be considered as motor vehicles that obstruct parking operation in the Car Park unless parking is based on an individual written contract according to Section 1.7 of the Terms and Conditions. Motor vehicles with a groundlessly triggered alarm or lights turned on are also considered to be obstructing the Car Park operation.
    6. Motor vehicles that obstruct traffic in the Car Park or vehicles parked in violation of these Terms and Conditions may be towed from the Car Park at the expense of the owners of the vehicles and returned to the owners only after paying the parking fee and other expenses.
    7. The entry and parking of motor vehicles with leaks of operating fluids or other technical defects is prohibited, and the Customer is obliged to pay for any damage caused by the poor technical condition of the motor vehicle.
    8. Any persons, animals or substances that may cause damage to the Operator or third parties or otherwise disrupt the use of the Car Park shall not be left in parked motor vehicles after parking.
    9. Persons who move in the Car Park area are responsible for any damage caused by their actions to the Operator or third parties. Children and animals can only move in the Car Park accompanied by adults who are responsible for their safety.
    10. The Operator is entitled to apply retention right to secure their receivables against the Customers. The Customer will be able to get out of the Car Park or take their motor vehicle from the parking area for towed vehicles only after the receivables, damages and other receivables are settled or only after recording the damage record with the driver’s obligation to pay for the damage found or providing a different guarantee for securing the claim (debt) on the part of the driver or the owner of the vehicle if the amount of damage cannot be determined.
    11. The Operator is not responsible for the loss or damage to the things left in parked motor vehicles.
  3. Rules for Using the Transport
    1. The Operator provides the Transport with visibly marked Minibuses.
    2. The station of departure in the Car Park is located next to the service Portakabin at the entrance gate.
    3. Getting on and off the Minibuses is subject to driver’s instructions.
    4. Customers under the influence of alcohol, narcotics or psychotropic substances, disturbing the attention of the Minibus drivers or soiling the Minibuses may be excluded from the Transport.
    5. The Transport price is included in the parking fee.
  4. In the Car Park, It Is Forbidden to
    1. Carry out maintenance and repairs of parked motor vehicles, including refilling the operating fluids.
    2. Clean the interior of parked motor vehicles, empty and throw away cigarette butts, remove mud from parked motor vehicles and soil the parking spaces and the Car Park premises in any other way.
    3. Wash or clean bodywork and engines of parked motor vehicles.
    4. Furthermore, the Customers are forbidden to do the following in the Car Park premises and for safety reasons:
      1. move around the Car Park under the influence of alcohol, narcotic or psychotropic substances that reduce attention,
      2. stay in parked vehicles longer than necessary,
      3. ride bicycles, scooters, roller-skating, skateboarding or drive other means of transport (e.g. karts),
      4. leave animals free (e.g. dogs without a leash, muzzle),
      5. carry out stand selling or soliciting, dealer activities and all activities of political, assembly or manifestation character, including charity events,
      6. place leaflets, banners, prompts, etc. in the Car Park, also if attached to the body of the parked motor vehicles,
      7. beg, perform any dance, conjuring, musical or singing performances,
      8. carry out any other entertainment activities, including betting, lottery or gambling, damage the equipment of the owner of the Car Park installed in the Car Park.
    5. In the event of a breach of the obligations set forth in the Terms and Conditions, the Customer is obliged to pay a contractual penalty of CZK 5,000 to the Operator and to compensate for the damage caused.
  5. Final Provisions
    1. Minibuses drivers, car park guards or other persons authorized by the Operator are, if they deem it appropriate, entitled to request explanations from Customers violating the Terms and Conditions, they are entitled to claim the appropriate penalty and other claims, to prevent the departure of parked motor vehicles if they have doubts, or, as the case may be, to banish the Customers from the Car Park.
    2. Partial invalidity of certain provisions does not affect the validity of the other provisions.
    3. Unlawful action of any persons present in the Car Park premises is solved by the affected notifying the Police of the Czech Republic and other bodies involved in criminal procedure.
    4. Handling of personal data by Invia is described in the Information Memorandum on the Processing of Personal Data of Clients.
    5. If you provide us with personal data of third parties, you declare that these third parties consented to the provision of their personal data to Invia.
    6. These Terms and Conditions become effective on 25 May 2018.
